Terms of Service, Conditions of Use, and Cancellation Policy

These terms govern your use of the MindLift Alliance website, your clinical care with our licensed clinicians, and your enrollment in MindLift Academy continuing education and court-ordered classes. Please read them before scheduling an appointment or purchasing a course.

This website is not for emergencies

MindLift Alliance does not provide crisis or emergency services, and this website is not monitored around the clock. If you or someone else is in immediate danger, call 911.

If you are in emotional distress or having thoughts of suicide, call or text 988 to reach the Suicide & Crisis Lifeline, available 24 hours a day. Do not use our contact forms, email, text messages, or the client portal to report an emergency.

Agreement to these terms

These Terms of Service and Conditions of Use form a binding agreement between you and MindLift Alliance Therapy & Counseling Associates. By using this website, requesting an appointment, completing an intake form, purchasing a course, or enrolling in a class, you confirm that you have read these terms and agree to them.

If you do not agree, please do not use the website or our services.

These terms cover our website and our commercial relationship with you. They do not replace the clinical documents you sign before treatment begins, including the Informed Consent for Treatment, the Telehealth Consent, and the Notice of Privacy Practices. If a signed clinical document conflicts with anything on this page, the signed document governs your care.

Who we are and what we offer

MindLift Alliance is a licensed outpatient mental health practice based at 8951 Collin McKinney Pkwy #801, McKinney, Texas 75070. We operate three connected service lines:

  • Clinical counseling. Individual, teen, couples, family, and group therapy delivered in person in McKinney and by telehealth across Texas.
  • MindLift Academy. Continuing education for licensed mental health professionals, state CE renewal bundles, and Texas LPC Supervisor training.
  • Court-ordered and community classes. Self-paced online programs including anger management, substance abuse education, parenting and co-parenting, impulse control, theft awareness, cognitive behavioral life skills, and trauma-informed care.

Different sections of these terms apply to different services. Sections 5 through 7 apply to clinical care. Sections 8 through 12 apply to courses and classes. The remaining sections apply to everyone who uses this website.

Website use does not create a treatment relationship

Information on this website is general education. It is not therapy, not a diagnosis, and not a substitute for care from a qualified professional. Reading our pages, submitting a contact form, requesting an appointment, or exchanging messages with our intake team does not create a therapist-client relationship.

A treatment relationship begins only when you have completed intake, signed our informed consent documents, been accepted by a MindLift Alliance clinician, and attended a scheduled appointment.

Never delay seeking professional advice, or disregard advice you have received, because of something you read here.

Eligibility, age, and consent

To purchase services, enroll in a course, or create an account, you must be at least 18 years old and able to enter a binding contract.

Minors. We provide therapy to children and adolescents. A parent or legal guardian must consent to treatment, complete intake paperwork, and handle scheduling and payment. Where a minor is enrolled in a teen class, the parent or guardian is the account holder and is responsible for these terms. In shared custody or separation situations, the consenting adult confirms they hold the legal authority to consent to the minor’s care under their custody order.

Location. Our clinicians are licensed in Texas. You must be physically located in Texas at the time of a therapy session, whether in person or by telehealth. If you relocate or travel outside Texas, tell your clinician before your next appointment so we can discuss options. Online courses and CE are available nationwide and are not subject to this restriction.

Clinical counseling services

All therapy is provided by clinicians licensed through the Texas Behavioral Health Executive Council. Some services are delivered by associate-level clinicians practicing under board-approved supervision. Your clinician’s license type, supervision status, and supervisor’s name are disclosed to you in writing before treatment begins.

Clinical judgment and referrals

We accept clients when we believe we can help. If your needs fall outside our scope, or would be better served by a higher level of care such as intensive outpatient, inpatient, or psychiatric treatment, we will tell you and provide referrals. We may decline or end services when treatment is not clinically appropriate, and we will do so in a manner consistent with our ethical obligations.

Telehealth

Telehealth sessions are conducted over a secure, HIPAA-compliant platform. You are responsible for having a reliable internet connection, a working device with a camera and microphone, and a private location where you will not be overheard. You may not record a session without your clinician’s written permission, and your clinician will not record without yours.

If a session is interrupted by a technical failure, your clinician will attempt to reconnect. If the connection cannot be restored, your clinician will contact you by phone to complete or reschedule the session. A session lost to a documented technical failure on our end is not charged.

Group therapy

Group members agree to keep the identity and disclosures of other members confidential. We can require this commitment, but we cannot guarantee that every member will honor it, and we are not liable for disclosures made by other group members.

Medication

Our counselors do not prescribe or manage medication. If medication may be helpful, we will coordinate a referral to a prescriber with your written authorization.

How to cancel or reschedule

Cancel or reschedule through the client portal, by calling (972) 855-8183, or by emailing info@mindliftalliance.com. The time your message is received is what counts, not the time it was sent. Voicemail and email sent outside business hours are received the next business day, so please allow for that when you are close to the deadline.

Late cancellations and missed appointments

Your appointment time is reserved for you alone. When it is cancelled at short notice, that hour usually cannot be offered to another client who needs it.

  • Cancel or reschedule at least 24 hours before your appointment and there is no charge.
  • Cancel with less than 24 hours’ notice and a $60 late cancellation fee applies.
  • Miss an appointment without notice and a $60 no-show fee applies.
  • Arrive more than 15 minutes late and your clinician may need to treat the appointment as a missed session. Where time allows, we will hold a shortened session instead, billed at the full rate.

Late cancellation and no-show fees are your responsibility. Insurance plans do not reimburse missed appointments, so these fees cannot be billed to your insurer and cannot be applied to your deductible.

When we waive the fee

We understand that life interferes. We waive these fees at our discretion for genuine emergencies, sudden illness, hazardous weather, and similar circumstances outside your control. Every client is also allowed one courtesy waiver. Contact us as soon as you are able and we will work with you.

Repeated missed appointments

Consistent attendance is part of effective treatment. After three late cancellations or missed appointments, your clinician will discuss whether the current schedule is working, and we may move you to a different appointment time, place you on an as-available basis, or end treatment and provide referrals.

Group therapy and time-limited programs

Group sessions and program-based services such as the couples enrichment group and the after-school social skills group are billed for the full program. Because group size and curriculum are planned in advance, missed group sessions are not refunded, credited, or made up individually.

Cancellations by MindLift Alliance

If we cancel your appointment for any reason, including clinician illness or an office closure, you are never charged. We will contact you as soon as we can and offer the earliest available alternative time.

This cancellation policy applies to therapy appointments only. Online courses and classes are covered by the course refund policy in section 10.

Fees, insurance, and payment

Current self-pay rates, accepted insurance plans, and payment options are listed on our Insurance & Pay page. Rates vary by clinician credentials and service type, and are confirmed with you before your first session.

Insurance

We verify your benefits as a courtesy before treatment begins. Verification is not a guarantee of payment. Your insurance contract is between you and your insurer, and you remain responsible for copays, coinsurance, deductibles, and any amount your plan denies or does not cover. If your plan requires prior authorization and it is not obtained, or if your coverage lapses, the full session rate becomes your responsibility.

Self-pay and Good Faith Estimates

Under the federal No Surprises Act, clients who are uninsured or who choose not to use insurance have the right to receive a Good Faith Estimate of expected costs before services begin. We provide one on request and at intake.

Payment method on file

We require a valid payment method on file to hold a recurring appointment time. By providing it, you authorize us to charge session fees, copays, outstanding balances, and any late cancellation or no-show fees described in section 6. We will notify you before charging a cancellation or no-show fee.

Past-due balances

Balances are due when billed. If an account falls significantly past due, we may pause scheduling until it is resolved and, where necessary, refer the balance for collection. We will always attempt to reach you and arrange a payment plan first, and we will not withhold care in a clinical emergency over a balance.

MindLift Academy courses and CE credit

MindLift Academy offers self-paced online continuing education for licensed mental health professionals. MindLift Alliance is approved by the National Board for Certified Counselors as an Approved Continuing Education Provider, ACEP No. [NBCC ACEP number]. MindLift Alliance is solely responsible for all aspects of the programs it presents. Programs that do not qualify for NBCC credit are clearly identified.

Earning credit

To receive a certificate of completion you must work through the full course, pass any required assessment, and complete the course evaluation. Certificates are issued to the name on your account, so please make sure your name and license number are entered correctly before you begin. Certificates are available for download from your student dashboard and can be re-downloaded at any time.

Board acceptance

NBCC approval does not guarantee that a course will be accepted by every state licensing board. Boards set their own content and hour requirements, and those requirements change. Confirm with your own licensing board that a course satisfies your renewal requirement before you enroll. We cannot refund a completed course that your board later declines to accept.

Course content is education, not clinical or legal advice

Course materials are for professional education. They do not establish a supervisory, consultative, or therapeutic relationship, and they are not legal advice. You remain responsible for your own clinical decisions and for practicing within your scope and licensure.

Changes to courses

We update course content to reflect current standards and may revise, retire, or replace a course. If a course you have purchased but not yet completed is retired, we will give you access to the replacement or a comparable course at no additional cost.

Court-ordered and community classes

Verify with your court before you enroll. Acceptance requirements vary by jurisdiction, by judge, and by the specific wording of your order. You are responsible for confirming with your court, probation officer, or attorney that our program format and hour count satisfy your requirement. If you are unsure, call us at (972) 855-8183 with your order in hand and we will help you choose before you pay.

Our court-ordered classes are self-paced and delivered online by licensed Texas mental health professionals. Access begins as soon as payment is processed.

Certificates and documentation

A digital certificate of completion is issued immediately after you finish the final assessment, and includes the program title and description, facilitator name and credentials, completion date, and total hours. You can download it from your dashboard at any time. On request, we will also prepare a formal completion letter on MindLift Academy letterhead for court submission.

We issue certificates based on the information in your account. Certificates are issued in your legal name. If a certificate needs to be reissued because you entered your name incorrectly, contact us and we will correct it.

Honest completion

You must complete the coursework yourself. Having another person complete any part of a course on your behalf, sharing account access, or otherwise misrepresenting your participation is grounds for immediate termination without refund and for revocation of any certificate issued. Where a certificate has already been submitted to a court, we may be obligated to notify the court that it has been revoked.

Deadlines

Our platform does not impose a deadline, but your court order does. Enroll early. We are not responsible for consequences arising from a program completed after a court deadline.

Confidentiality

Your enrollment and completion information is released to a court, probation officer, or attorney only with your written authorization, or where we are compelled by a valid court order or subpoena. We do not share it with employers or family members without your written consent.

Course refund and transfer policy

This policy applies to all MindLift Academy purchases, including CE courses, state renewal bundles, LPC Supervisor training, and court-ordered classes. It does not apply to therapy appointments, which are covered by section 6.

Full refund

You may request a full refund within 7 days of purchase, provided you have completed no more than 25% of the course and no certificate has been issued.

No refund

  • After a certificate of completion has been issued.
  • More than 7 days after purchase.
  • Once more than 25% of the course content has been accessed.
  • Where a course or certificate was declined by a court or licensing board that you did not confirm with in advance.

Bundles

State CE renewal bundles are refundable under the same 7-day window provided no course inside the bundle has been completed and no certificate has been issued. Individual courses inside a bundle are not refundable separately.

Transfers and duplicate purchases

If you enrolled in the wrong program, contact us. We will transfer you to the correct course once at no charge, provided you have not completed the original and no certificate has been issued. Where the correct course costs more, you pay the difference. Accidental duplicate purchases are refunded in full.

Cancellations by MindLift Academy

If we cancel or discontinue a course you have paid for and cannot offer a comparable replacement, you receive a full refund.

How to request a refund

Email info@mindliftalliance.com with your name, the course title, and the date of purchase. We respond within 3 business days and issue approved refunds to the original payment method within 10 business days.

Student accounts and course access

Accounts are for one person. You are responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away if you believe your account has been accessed by someone else.

Course access is personal and non-transferable. You may not share, resell, or give access to your enrollment.

Unless a specific enrollment period is stated at purchase, you retain access to a purchased course for 12 months from the date of purchase. Certificates already earned remain downloadable after access ends.

We may suspend or close an account that violates these terms, and no refund is due where the closure results from a violation.

LPC Supervisor training and supervision

Our Texas LPC Supervisor training is designed to align with the Texas Behavioral Health Executive Council requirements at Texas Administrative Code §681.147. Completing the course and receiving a certificate is one requirement among several. You must still meet the board’s licensure, experience, and application requirements, and the board decides whether to grant supervisor status.

Board rules change. Confirm current requirements directly with the Texas Behavioral Health Executive Council before enrolling. We do not guarantee any licensure or designation outcome.

Listings in our supervisor directory are provided for informational purposes. Inclusion is not an endorsement, and we do not verify or warrant the credentials, availability, or fitness of any listed supervisor. Any supervision agreement you enter is between you and that supervisor.

Email, text, and appointment reminders

By giving us your phone number or email address, you agree that we may contact you about appointments, intake, billing, and courses. This includes automated appointment reminders by text and email.

Standard message and data rates may apply. You can opt out of text messages at any time by replying STOP, and out of marketing email using the unsubscribe link. Opting out of marketing does not stop essential messages about your appointments, billing, or course enrollment.

Email and standard text messaging are not fully secure. We keep clinical detail out of them and ask that you do the same. Use the client portal for anything sensitive. Messages sent to us are not monitored continuously and are not an appropriate channel for urgent needs.

Privacy, confidentiality, and HIPAA

How we collect, use, and protect your information is described in our Privacy Policy and, for protected health information, in our Notice of Privacy Practices, which is provided to you at intake.

Clinical confidentiality is protected by HIPAA and Texas law, with limited exceptions required by law. These include suspected abuse or neglect of a child, an elderly person, or a person with a disability; a serious and imminent threat of harm to yourself or an identifiable other; and a valid court order or subpoena. Your clinician will explain these exceptions during informed consent.

Website analytics and marketing tools are used on our public pages, not on the client portal. They collect general usage data and are not used to identify you as a client.

Intellectual property

All content on this website and in our courses, including text, curriculum, slides, videos, workbooks, assessments, graphics, logos, and the MindLift Alliance and MindLift Academy names, is owned by MindLift Alliance or licensed to us, and is protected by copyright and trademark law.

When you purchase a course you receive a limited, personal, non-transferable license to view the materials and to download any materials we designate as downloadable, for your own professional or personal use. You may not copy, record, republish, resell, distribute, or use our course content to teach or deliver your own program.

You may quote or link to short excerpts from our public blog with clear attribution and a link back to the original page.

Acceptable use

When using our website, portal, or course platform, you agree not to:

  • Provide false information at intake, enrollment, or checkout.
  • Access another person’s account or attempt to bypass security.
  • Upload malicious code, scrape the site, or interfere with its operation.
  • Harass, threaten, or abuse our staff, clinicians, or other participants.
  • Record or redistribute sessions or course content without written permission.
  • Use our services for any unlawful purpose.

We may restrict or end access for anyone who violates these rules.

Third-party platforms and links

We use trusted third-party services to operate, including TherapyPortal for scheduling and secure client messaging, our telehealth platform, our learning platform, and our payment processors. Your use of those services is also governed by their own terms and privacy policies. We select vendors with appropriate safeguards and business associate agreements where required, but we do not control their systems.

Our website links to outside organizations such as licensing boards and government resources. We provide these links for convenience and are not responsible for the content, accuracy, or availability of any external site.

Testimonials, reviews, and outcomes

Any client statements shown on this site are shared voluntarily and with written authorization. They describe one person’s experience and are not a promise of results.

Therapy outcomes depend on many factors, including your circumstances, your engagement, and the nature of your concerns. We do not guarantee any particular clinical result, and we do not guarantee that a course will be accepted by a specific court or licensing board.

Disclaimers

Our website and online course platform are provided on an as-is and as-available basis. We work to keep them accurate and running, but we do not warrant that they will be uninterrupted, error free, or free of harmful components, and we do not warrant that all content is complete or current at every moment.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in this section limits any liability that cannot be limited under law, including liability arising from the professional obligations of our licensed clinicians.

Limitation of liability

To the fullest extent permitted by Texas law, MindLift Alliance and its owners, clinicians, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our online course platform, including lost profits, lost data, or loss of goodwill.

Our total liability for any claim relating to a course or to your use of this website is limited to the amount you paid us for that course or service in the 12 months before the claim arose.

This section does not limit liability for professional negligence in the provision of clinical services, for gross negligence or willful misconduct, or for any other liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless MindLift Alliance and its owners, clinicians, employees, and contractors from claims, damages, and reasonable legal costs arising out of your violation of these terms, your misuse of our website or course platform, or your infringement of another party’s rights.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules.

If a dispute arises, please contact us first. Most concerns are resolved quickly by talking them through. If we cannot resolve it informally, both parties agree to attempt mediation in Collin County, Texas before starting litigation, with mediation costs shared equally.

Any dispute not resolved through mediation will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the jurisdiction of those courts.

If any provision of these terms is found unenforceable, the remaining provisions stay in full effect.

This section governs commercial and website disputes. It does not waive any right you have to file a complaint with a licensing board, as described in section 23.

Complaints and grievances

We want to hear about it if something goes wrong. Contact us at info@mindliftalliance.com or (972) 855-8183. We acknowledge complaints within 3 business days and aim to resolve them within 30 days, in writing where you ask for a written response.

Clinical services. You have the right to file a complaint about a licensed clinician with the Texas Behavioral Health Executive Council. Nothing in these terms discourages or restricts that right.
